SECTION 2 – WHAT INFORMATION IS COLLECTED, HOW IS IT COLLECTED, AND HOW IS IT USED?
The Company may collect and store various types of information about you and your use of our Services, generally classified as Personal Information and Non-Personal Information.
The Company gathers and uses Personal Information internally in connection with providing the Services, including to personalize, evaluate, and improve the Services; to contact you; to respond to and fulfill your requests regarding the Services; to analyze how you use the Services; and for compliance purposes including audits, fraud monitoring and prevention, and any other legal process deemed necessary and applicable (i) to comply with federal, state, and local laws, (ii) to protect our rights, privacy, safety, or property and/or that of our affiliates and customers, or (iii) to allow the Company and/or its affiliates to pursue damages or remedies available under applicable law.
Personal Information
Personal Information is information you provide to us voluntarily, or that is collected passively through your use of the Services and/or Website, that is directly associated with or reasonably linked to a specific person, computer, or device.
We collect Personal Information such as your name, email address, telephone number, property address, mailing address, information about the property you are inquiring about, and any other information you choose to submit through our forms or in communications with us.
Sources of Personal Information. We collect Personal Information primarily and directly from you when you voluntarily submit a form on our Website, call or text us, or otherwise communicate with us. We may also obtain limited information from publicly available sources — including county property records, assessor and recorder data, and public listing data — from service providers that verify or correct contact information you have already provided to us, and from licensed real estate professionals, title companies, and other transaction participants working with us on your transaction, in each case for the purpose of evaluating, marketing, and completing the transaction you have inquired about.
We do not purchase consumer marketing lists for the purpose of sending marketing communications to individuals who have not contacted us.
Communications With You
The Company will communicate with you if you have provided us with the means to do so. If you have given us your email address or telephone number, we may email, call, or text you about your inquiry, your property, offers relating to your property, and other transactional and marketing information, subject to the consent and opt-out provisions in Section 5.
Combining Information
The Company reserves the right to combine Personal Information collected from the Website with additional Personal Information you have provided to us through other channels, including telephone calls, text messages, and email correspondence.
Some forms of Non-Personal Information described below will be treated as Personal Information if required by applicable law, or when such information is directly associated with or reasonably linked to a specific person, computer, or device, or is combined with other Personal Information.
Transmission Security
Personal Information you send and receive is transmitted over networks that may be subject to interception by unauthorized third parties. While it is the Company's objective to take reasonable measures to reduce that risk, the Company cannot and does not guarantee that transmissions over the internet are secure or error-free.
We recommend that you use caution when sending Personal Information over the internet, and that you use encryption technology whenever possible, such as websites that display the "https" designation in the address bar.
SECTION 3 – CALL, TEXT, AND COMMUNICATION RECORDING AND MONITORING
PLEASE READ THIS SECTION CAREFULLY.
Telephone calls to and from the Company are recorded. The Company records, monitors, stores, transcribes, and analyzes inbound and outbound telephone calls, voicemail messages, text messages, and other communications between you and the Company, its employees, contractors, agents, and service providers. Recordings and transcripts are stored in our customer relationship management system and related service provider platforms.
These recordings are made and retained for quality assurance, training, dispute resolution, transaction documentation, regulatory compliance, verification of consent, and business record-keeping purposes.
By submitting a form on the Website, by placing a call to the Company, by accepting a call from the Company, or by continuing a call after being notified that the call is recorded, you knowingly and voluntarily consent to the recording, monitoring, storage, transcription, and analysis of that communication by the Company and its service providers.
The Company operates and receives inquiries nationwide. Certain states require the consent of all parties to a communication before it may be recorded. This consent is given by you with respect to all jurisdictions, including all "all-party consent" and "two-party consent" states, regardless of your location or the location of any party to the communication. If you do not consent to being recorded, you must not submit a form on the Website, must not place or accept telephone calls with the Company, and should instead communicate with us in writing at info@silverstoneproperties.org.
The Company may also use automated and artificial intelligence tools to transcribe, summarize, and analyze recorded communications. Your consent above extends to such processing.
SECTION 4 – COOKIES, TRACKING TECHNOLOGIES, AND ANALYTICS
Cookies
A cookie is a small data file downloaded to a computer or device when a website is visited. The Company may use functional, performance, advertising, social media, and content cookies. Cookies allow for a better browsing experience by allowing the Website to remember your actions and preferences.
Most browsers automatically accept cookies, but you can choose whether to accept cookies through browser controls, which are typically found in the browser's "Tools," "Settings," or "Preferences" menu. Removing or blocking cookies can negatively impact your experience, and parts of our Website may no longer be fully accessible.
Third-Party Tracking Technologies We Use
The Company uses the following third-party technologies on the Website, which may collect information about your device, your interactions with the Website, and your communications with us:
WhatConverts — call tracking, form tracking, and lead attribution. WhatConverts may assign and display a unique tracking telephone number to you, record and store telephone calls placed to or from those numbers, capture form submission data, and associate your activity on the Website with your subsequent telephone call or form submission.
Google Ads (including Google conversion tracking, remarketing tags, and the Google Ads pixel) — advertising delivery, conversion measurement, and remarketing. This technology may be used to serve you advertisements on Google properties and partner sites after you leave our Website.
Google Sheets and other Google Workspace services — storage and processing of lead and inquiry data submitted through our forms.
By using the Website, placing or receiving a telephone call in connection with the Website, or submitting a form, you consent to the use of these technologies and to the collection, recording, interception, storage, and transmission of your Website activity, form data, and telephone communications by these third-party service providers on our behalf.
These third parties maintain their own privacy policies, which we encourage you to review. We do not control, and expressly disclaim responsibility for, the independent data practices of these third parties.
Do Not Track and Opt-Out Signals
The Company will honor a Global Privacy Control ("GPC") or similar browser-based opt-out preference signal as a request to opt out of targeted advertising and the sharing of Personal Information for advertising purposes, to the extent required by applicable law and to the extent our Website is technically capable of recognizing that signal.
Other Information
The Company may collect and store Other Information, meaning information that does not reveal your specific identity or does not directly relate to an identifiable individual, such as browser and device information, Internet Protocol ("IP") address, referring URL, pages visited, average time spent on the Website, information collected through cookies and similar technologies, and aggregated information.
SECTION 5 – MARKETING COMMUNICATIONS, CONSENT, AND OPT-OUT
Consent to Contact
We contact you only where you have provided your prior express written consent, or where the contact is exempt from consent requirements under applicable law (including transactional communications and communications relating to an existing transaction with you).
You acknowledge that calls and text messages from the Company may be placed or sent using an automatic telephone dialing system, an artificial or prerecorded voice, or similar technology, and that your consent is not a condition of any purchase, sale, or transaction with the Company.
Message and data rates may apply. Message frequency varies.
Mobile Information and Text Messaging — Important
The Company does not share, sell, rent, lease, or otherwise disclose mobile telephone numbers, SMS opt-in data, or text messaging consent to any third party or affiliate for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties for their own marketing or promotional purposes.
Mobile information may be shared only with service providers, subcontractors, and vendors that support the Company's own communications with you — such as our customer relationship management platform, telephony provider, and messaging platform — and only to the extent necessary for those providers to perform services for us. Those providers are contractually prohibited from using that information for their own marketing purposes.
How to Opt Out
Text messages: Reply STOP — or any other clear request to stop, such as "quit," "cancel," "remove me," or "do not contact me" — to any text message. You are not required to use any particular word.
Email: Click the "Unsubscribe" link in the footer of any marketing email.
Telephone calls: Tell the representative you wish to be placed on our internal Do-Not-Call list, or follow the opt-out instructions in any prerecorded message.
All channels: Email info@silverstoneproperties.org or write to the mailing address in Section 1, stating the telephone number, email address, or property address you wish to have suppressed.
You may continue to receive communications relating to an active transaction, closing, or existing obligation after opting out of marketing communications.
Internal Do-Not-Call Policy
The Company maintains a written internal Do-Not-Call policy in accordance with 47 C.F.R. § 64.1200(d). That written policy is set forth in full at Section 12 below and is available free of charge upon demand by emailing info@silverstoneproperties.org or writing to the mailing address in Section 1.
SECTION 6 – DISCLOSURE OF INFORMATION
Personal Information
The Company does not sell your Personal Information, and does not share your Personal Information with third parties for those third parties' own marketing or promotional purposes.
The Company may disclose Personal Information as follows:
To service providers. We share Personal Information with vendors, contractors, and service providers who perform services for us, including customer relationship management, call tracking and recording, telephony and messaging, data storage, marketing and advertising platforms, title and escrow companies, attorneys, inspectors, contractors, lenders, and transaction coordinators. These parties are permitted to use the information only as necessary to perform services for us.
In connection with a transaction. If you enter into or pursue a transaction with us relating to real property, we may disclose your Personal Information to parties necessary to complete that transaction, including title companies, closing attorneys, escrow agents, lenders, assignees, appraisers, inspectors, insurers, prospective buyers and their agents, and county and municipal recording offices.
Public marketing of your property. Depending on the transaction structure you agree to, we or a licensed real estate professional acting with us may publicly market your property in order to locate a buyer. This may include listing the property on the Multiple Listing Service (MLS), public real estate listing portals and search sites, social media, email and text marketing to buyer lists, printed materials, and signage. Information disclosed through such marketing may include the property address, photographs and video of the interior and exterior, property condition and repair details, square footage and features, occupancy status, and the asking price. Once information is published to the MLS or a public listing portal, it may be copied, syndicated, indexed, and retained by third parties outside our control, and we cannot recall or delete it. The specific transaction structure applicable to your property, and whether public marketing will occur, is set forth in the written agreement you sign with us. Your name and contact information are not published as part of standard listing marketing.
Corporate transactions. In connection with a potential or actual sale, merger, financing, reorganization, or corporate restructuring of the Company or its assets.
Legal and protective purposes. The Company reserves the right to access, read, preserve, and disclose any Personal Information, Non-Personal Information, or Other Information to which it has access if it has a good faith belief that doing so (i) will implement and/or enforce the terms and conditions of this Privacy Policy or our Terms of Service; (ii) is necessary in connection with any actual or anticipated legal process, claim, audit, investigation, or dispute; or (iii) is required or permitted by federal, state, or local law.
With your direction or consent. Where you have asked or authorized us to do so.
Advertising
The Company may use Personal Information to send you marketing and advertising messages relating to our Services. We may deliver advertising based on the content of the pages you view ("Contextual Advertising"), and advertising customized based on your prior interactions with our Services ("First Party Advertising").
You may opt out of First Party Advertising but not Contextual Advertising. No Personal Information is used to deliver Contextual Advertising. You may continue to receive general advertising after opting out of First Party Advertising, but such advertising will not be customized or personalized.
Other Information
The Company may use and disclose Other Information for any lawful purpose, including research, reporting, analytics, and improving the Website, and may share aggregated and non-identifying information with advertisers and partners. If we combine Other Information with Personal Information, the combined information will be treated as Personal Information for as long as it remains combined. If we are required to treat Other Information as Personal Information under applicable law, we may use it for all the purposes for which we use and disclose Personal Information.
SECTION 7 – THIRD-PARTY WEBSITES AND SERVICES
You may always choose not to disclose Personal Information to the Company. However, certain Personal Information is necessary for us to provide the Services to you. You may opt out of the use of your Personal Information for marketing or advertising purposes, but not for business or operational purposes necessary to provide the Services or complete a transaction.
Third-party service providers used by us will collect, use, and disclose your information only to the extent necessary to allow them to perform the services they provide to us. Certain third-party service providers have their own privacy policies with respect to information we provide to them, and we recommend that you read those policies.
Once you leave our Website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our Terms of Service. This Privacy Policy does not address, and we are not responsible for, the privacy practices of any third parties or other sites. The inclusion of a link on the Website does not constitute or imply the Company's endorsement, recommendation, or sponsorship of the content, goods, services, business, or privacy practices of the linked site.
SECTION 8 – YOUR PRIVACY RIGHTS
Rights Available to All Users
You may access, review, correct, or request deletion of the Personal Information we maintain about you by contacting us at info@silverstoneproperties.org or at the mailing address in Section 1. Please include your full name, the email address and telephone number you provided to us, the property address associated with your inquiry, and a description of your request.
We may retain historic email, billing, service, and property addresses, and records of communications and consent, for security, verification, transaction documentation, legal compliance, and record-keeping purposes, and such information may not be deleted. When you update Personal Information, we may maintain a copy of the unrevised information in our records. We may continue to use aggregated data derived from or incorporating your Personal Information after you update or delete it, provided it does not identify you personally. We may also retain Personal Information after you are no longer a customer as required by our business practices, by law, and for tax and litigation-hold purposes.
Your Virginia Privacy Rights
If you are a resident of the Commonwealth of Virginia, the Virginia Consumer Data Protection Act ("VCDPA") provides you with the following rights with respect to Personal Information we process about you:
1.Right to confirm and access. To confirm whether we are processing your personal data and to access such personal data.
2.Right to correct. To correct inaccuracies in your personal data, taking into account the nature of the data and the purposes of processing.
3.Right to delete. To delete personal data provided by or obtained about you.
4.Right to a copy. To obtain a copy of the personal data you previously provided to us in a portable and, to the extent technically feasible, readily usable format.
5.Right to opt out. To opt out of the processing of your personal data for purposes of (a) targeted advertising, (b) the sale of personal data, or (c) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.
We do not sell personal data as that term is defined by the VCDPA, and we do not engage in profiling in furtherance of decisions producing legal or similarly significant effects.
How to submit a request. Submit requests by email to info@silverstoneproperties.org with the subject line "Virginia Privacy Rights Request," or by mail to the address in Section 1. We will verify your identity using the information you previously provided to us, and may request additional information reasonably necessary to authenticate you and your request. We will respond within forty-five (45) days of receipt. That period may be extended once by an additional forty-five (45) days where reasonably necessary, and we will inform you of any such extension within the initial response period and explain the reason for the extension.
Authorized agents. You may use an authorized agent to submit an opt-out request on your behalf. We may deny a request from an agent who does not submit proof that they have been authorized by you to act on your behalf.
RIGHT TO APPEAL. If we decline to take action on your request, we will inform you of the reason for that decision and provide instructions for appealing it. To appeal a denial, send an email to info@silverstoneproperties.org with the subject line "Virginia Privacy Rights Appeal," or write to the mailing address in Section 1, Attn: Privacy Officer – Appeals. Include a copy of or reference to your original request and the basis for your appeal. We will respond to your appeal in writing within sixty (60) days of receipt, and will set forth a written explanation of the reasons for the decision. If your appeal is denied, you may contact the Attorney General of Virginia to submit a complaint at https://www.oag.state.va.us/consumercomplaints.
Residents of Other States
We market our services nationwide and may receive inquiries from residents of states that have enacted comprehensive consumer privacy laws, including California, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and others. Where such a law applies to the Company and to you, we will honor the rights that law provides to you — including rights of access, correction, deletion, portability, and opt-out of targeted advertising and the sale of personal information — on the same terms and through the same request and appeal process described above for Virginia residents. Submit such requests to info@silverstoneproperties.org, identifying your state of residence in the subject line.
We do not sell personal information, and we do not knowingly sell the personal information of any consumer under the age of sixteen (16).
We will not discriminate against you for exercising any privacy right, and will not deny you services, charge you a different price, or provide you a different level or quality of service because you exercised a privacy right.
SECTION 9 – DATA RETENTION
We retain Personal Information for as long as necessary to fulfill the purposes described in this Privacy Policy, including to provide the Services, complete and document transactions, maintain records of consent, resolve disputes, enforce our agreements, and comply with our legal, tax, accounting, and regulatory obligations.
As a general matter, we retain lead and inquiry records, call recordings, and records of consent for a minimum of five (5) years from the date of last contact, consistent with the record retention periods applicable to telephone and text message consent. Transaction records are retained for the period required by applicable real estate, tax, and statute-of-limitations requirements. Records subject to a litigation hold are retained until the hold is released.
SECTION 10 – SECURITY
The Company implements reasonable administrative, technical, and physical safeguards designed to protect Personal Information against loss, misuse, unauthorized access, disclosure, alteration, and destruction. No method of transmission over the internet or method of electronic storage is completely secure, and the Company does not guarantee, represent, or warrant the security of any Personal Information transmitted to or stored by the Company.
You are also responsible for the security of your Personal Information. Where you have selected a password to access certain parts of our Website, you are responsible for keeping that password confidential and limiting access to your electronic devices and browser history. You agree to notify us promptly of any unauthorized use of your username, password, or account, and you acknowledge that you are solely responsible for any use of our Services through your username and password.
The Company will not send email or text communications requesting sensitive or confidential Personal Information such as a Social Security number, bank account or credit card account number, or driver's license number, and you should not respond to any communication purporting to be from the Company that requests such information. If you receive such a request, contact the Company immediately at info@silverstoneproperties.org.
SECTION 11 – AGE RESTRICTION
This Website and the Services are intended solely for individuals who are eighteen (18) years of age or older. By using this Website or submitting information to us, you represent that you are at least eighteen (18) years of age and at least the age of majority in your state or province of residence.
The Company does not knowingly collect, maintain, use, or sell personal information from individuals under eighteen (18) years of age, and does not knowingly collect personal information from children under thirteen (13) years of age in violation of the Children's Online Privacy Protection Act. If you believe we have inadvertently collected information from a minor, contact us immediately at info@silverstoneproperties.org and we will delete it.
SECTION 12 – INTERNAL DO-NOT-CALL AND CONSENT REVOCATION POLICY
This Section is the Company's written internal do-not-call policy, maintained in accordance with 47 C.F.R. § 64.1200(d) and applicable state telemarketing laws. It is published here and is available free of charge, upon demand, to any person. Requests for a copy may be made by email to info@silverstoneproperties.org or by mail to the address in Section 1. Any request received by any employee, contractor, or agent of the Company must be forwarded to the Compliance Officer the same business day and fulfilled within a reasonable time, not to exceed five (5) business days.
This Section applies to Silverstone Capital LLC and to all trade names, affiliates, and divisions under which it operates, including Virginia Home Buyers and Silverstone Properties. A do-not-call or revocation request received by any one of these is honored across all of them.
12.1 Compliance Officer
The Company designates a Compliance Officer responsible for maintaining this policy, maintaining the internal Do-Not-Call list, training personnel, investigating complaints, and responding to requests for this policy. The Compliance Officer may be reached at info@silverstoneproperties.org.
12.2 Scope of Outbound Contact
The Company contacts only individuals who have submitted an inbound inquiry form on a Company website and affirmatively checked a consent box authorizing contact by call, text, and email, or who have otherwise initiated contact with the Company by calling, texting, or emailing us.
The Company does not purchase, rent, license, or dial consumer marketing lists, and does not conduct cold-call campaigns to individuals who have not contacted us first.
Because every number the Company dials has been provided directly by the consumer through a form submission accompanied by express written consent — constituting both prior express invitation and an established business relationship — calls to those numbers fall within the exemptions at 47 C.F.R. § 64.1200(c)(2), and the Company does not routinely scrub against the National Do-Not-Call Registry.
This exemption is conditional. The following are strictly prohibited without prior written authorization from the Compliance Officer and implementation of registry scrubbing: dialing or texting any number obtained from a purchased, rented, shared, or scraped list; any number obtained through skip tracing, public records, or a data vendor; any expired listing, FSBO, foreclosure, or probate list; any number the consumer did not personally provide to the Company; and any referral where the referred party has not themselves contacted the Company. If the Company's lead sourcing changes to include any of the above, registry access must be obtained and a scrub cadence of no less than every thirty-one (31) days implemented before any such number is contacted.
12.3 The Internal Do-Not-Call List
The Company maintains an internal Do-Not-Call list within its customer relationship management system. A contact placed on the list is marked with a persistent, clearly visible do-not-contact designation, removed from all active call, text, and email sequences, and excluded from all future outbound campaigns.
A do-not-call or revocation request is recorded immediately and in all cases within thirty (30) days of receipt, and communications cease as soon as practicable and in no event later than ten (10) business days after receipt, as required by 47 C.F.R. § 64.1200(a)(10).
Internal Do-Not-Call list entries are retained for a minimum of five (5) years from the date of the request, and as a matter of Company practice are retained indefinitely. Entries are never purged, overwritten, or removed except as provided in Section 12.6.
When a contact is placed on the list, the Company suppresses the telephone number, email address, and — where identifiable — the individual and the associated property record. Suppression applies to marketing calls, prerecorded calls, text messages, and marketing emails from all Company trade names.
12.4 How a Request Is Made — Any Reasonable Manner
You may revoke consent in any reasonable manner that clearly expresses a desire not to receive further calls or messages. No employee, contractor, or agent of the Company may require you to use a specific word, a specific channel, or a specific form to opt out.
Personnel must treat all of the following as valid revocation requests:
-Any text reply containing stop, quit, end, revoke, opt out, cancel, unsubscribe, remove me, or similar
-Any plain-language statement by text, email, phone, voicemail, letter, or in person that a reasonable person would understand as a request to stop contact — for example, "please don't contact me again," "take me off your list," "I'm not interested, stop calling," or "I already sold"
-A request made to any employee, contractor, virtual assistant, or agent of the Company, on any channel
-A request made on behalf of the consumer by a family member, attorney, or authorized representative
-A statement that the number is a wrong number, reassigned, or belongs to someone else
Ambiguity is resolved in favor of the consumer. If a reasonable person could read a message as an opt-out, it is treated as an opt-out. The burden is on the Company to prove a request was not made in a reasonable manner.
12.5 No Messages After Revocation
Once a revocation request is received, the Company sends no further text messages of any kind to that number. The Company does not send a confirmation message, a follow-up message, a "just checking in" message, or any message asking whether you would like to be contacted in the future or inviting you to reconsider.
All text messages sent by the Company are composed and sent manually by a representative. There are no automated text message flows, sequences, or drip campaigns. A representative who receives a revocation request stops all further messaging to that contact immediately and marks the contact as do-not-contact before sending any further messages to anyone.
The one message that is permitted. Federal rules allow a single confirmation message following a text-message revocation. The Company's default practice is to send nothing. If a representative does send a confirmation, that message must be sent within five (5) minutes of the revocation request, must contain no promotional, marketing, or re-engagement content, and must not ask whether you would like to be contacted in the future, ask you to reconsider, or invite any reply. The only approved text is:
You've been unsubscribed and will not receive further messages from Silverstone Capital.
If more than five minutes have passed, no message is sent. No second message is permitted under any circumstance.
Monitoring for revocation requests. Because messaging is manual, personnel are responsible for reviewing all inbound replies for revocation requests. Inbound replies must be reviewed no less than once per business day, and any revocation request identified must be recorded and suppressed the same business day.
Requests received during a live call. If you ask to be placed on the do-not-call list during a call, the representative must acknowledge the request immediately and without argument, rebuttal, or attempt to overcome the objection — no rebuttal scripts, retention offers, or "before you go" pitches are permitted — confirm the number and email to be suppressed, end the call courteously, and mark the contact as do-not-contact before taking the next call and no later than end of shift.
12.6 Re-Engagement After Revocation
The Company does not solicit renewed consent from any person who has revoked. A suppressed contact may be removed from the internal Do-Not-Call list only if the consumer independently initiates new contact with the Company, provides new documented prior express written consent through a Company form, and the Compliance Officer approves the removal and records the date, the source of the new consent, and the identity of the approver. The original suppression record is retained even after removal.
12.7 Transactional Communications
Revocation of marketing consent does not bar communications necessary to an active, executed transaction — for example, scheduling a closing, title issues, or contract performance. Such communications are limited strictly to the transaction, contain no marketing content, and cease upon closing or termination of the agreement. When in doubt, personnel treat the communication as marketing and do not send it.
12.8 Training
As required by 47 C.F.R. § 64.1200(d)(2), no employee, contractor, virtual assistant, or agent may place outbound calls or send text messages on behalf of the Company until informed and trained on the procedures in this Section.
Training consists of reviewing this Section and covers: the scope of permitted contact; recognizing a revocation request made in any reasonable manner; the prohibition on rebuttals to opt-out requests; the restriction on messages after a revocation request; how to mark a contact as do-not-contact; calling-hour restrictions; and the requirement to identify oneself and the Company at the outset of every call.
Each person trained signs and dates a written acknowledgment confirming they have reviewed these procedures. Training is delivered at onboarding, refreshed at least annually, and repeated promptly whenever this Section is amended. The Compliance Officer retains the signed acknowledgments and a dated log recording each person trained, the date, and the version of this Section covered. Records are retained for five (5) years.
12.9 Identification and Calling Hours
On every outbound call, the representative promptly states their name, that they are calling on behalf of Silverstone Capital LLC, and the purpose of the call, and provides a telephone number at which the Company may be contacted: (872) 302-0505. A representative must never refuse or deflect a do-not-call request on the ground that requests must be submitted in writing.
Calling hours. Outbound marketing calls and texts are placed only between 8:00 a.m. and 9:00 p.m. in the recipient's local time zone, and within any narrower window required by the recipient's state law. Personnel determine the recipient's time zone from the area code and property location before dialing.
Responses to inbound inquiries. Where a person has just submitted a form on a Company website requesting that the Company contact them, the Company may return that contact promptly, including by artificial or prerecorded voice. Personnel should nonetheless avoid returning contact outside the 8:00 a.m. to 9:00 p.m. window in the recipient's local time zone. A form submitted late at night is returned the following morning rather than immediately.
12.10 State Law
Several states impose requirements stricter than federal law, including narrower calling windows, shorter or absent established-business-relationship exemptions, state registry scrubbing obligations, and private rights of action. Because the Company markets nationwide, personnel apply the stricter of federal or applicable state requirements in every case.
12.11 Complaints and Audit
Any complaint alleging unwanted contact — whether received directly, through a carrier, through a regulator, or through counsel — must be reported to the Compliance Officer the same business day. The Compliance Officer documents the complaint, verifies the suppression status of the number, preserves all related records including consent records, call recordings, and message logs, and places a litigation hold on them.
The Compliance Officer conducts a review no less than annually covering: a sample audit of suppression requests to confirm timely processing; sampling message logs for suppressed contacts to confirm no prohibited post-revocation messages were sent; verification that all lead sources remain within Section 12.2; completeness of training records; and any complaints received. Results of each review are documented and retained for five (5) years.
SECTION 13 – CHANGES TO THIS PRIVACY POLICY
The Company reserves the right to modify this Privacy Policy at any time. Non-material changes and clarifications take effect upon posting to the Website. If we make material changes to this Privacy Policy, we will update the "Last Updated" date at the top of this page and provide notice by reasonable means, which may include posting a notice on the Website or sending notice to the email address you provided. Material changes will become effective no earlier than thirty (30) days after they are posted, except where a shorter period is required by law. This thirty (30) day delay does not apply to Section 12 (Internal Do-Not-Call and Consent Revocation Policy), which the Company may amend effective immediately upon posting in order to comply with changes in telemarketing law or Company practice. Each version of Section 12 is dated, and prior versions are retained for at least five (5) years. Your continued use of the Website or Services after the effective date of a material change constitutes your acceptance of the revised Privacy Policy.
Changes to this Privacy Policy are not retroactive and will not be applied to disputes arising from conduct occurring before the effective date of the change.
